How To Comply With The Worker Protection Act 2023
Since October 2024, every UK employer has a positive duty to take reasonable steps to prevent sexual harassment of their workers. EHRC can investigate. Tribunal awards can be uplifted by 25 percent.
The Steps

Conduct a workplace risk assessment
Identify where harassment could occur: customer-facing roles, lone working, social events, hybrid working, third-party contractors. Document it.

Update your anti-harassment policy
Must explicitly cover third-party harassment (customers, suppliers, members of the public). State clear reporting routes and zero-tolerance commitment.

Deliver mandatory training to all staff
Including managers, contractors and seasonal workers. Refresh annually. Keep signed records of attendance.

Set up a confidential reporting channel
An anonymous reporting route (email, hotline or platform). Senior nominated officer responsible. SLA for response (e.g. 48 hours).

Brief managers on bystander intervention
Managers must intervene when they witness harassment, not wait to be told. Include this in performance objectives.

Audit and document everything
Keep evidence of policy updates, training records, risk assessments, reports received and outcomes. EHRC and tribunals will ask.
